These Terms of Use (“Terms”) are an agreement between you and Dasfair LLC (“we,” “us”), the maker of the TummyTrail mobile application (“the App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. What TummyTrail is — and is not
TummyTrail is a personal logging and tracking tool for digestive symptoms, meals, and related notes. TummyTrail is not a medical device and does not provide medical advice, diagnosis, or treatment. Any patterns, summaries, or correlations the App displays are informational reflections of the data you entered, not clinical conclusions. Always consult a qualified healthcare provider about symptoms, conditions, diets, or treatment decisions. Never disregard or delay professional medical advice because of something displayed in the App. If you are experiencing a medical emergency, call your local emergency number immediately.
2. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to these Terms and the rules of the app store you downloaded it from (Apple App Store or Google Play). You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the App except where the law permits it despite this restriction.
3. Your data and responsibility
All data you enter is stored on your device and is under your control (see our Privacy Policy at tummytrail.com/privacy). You are responsible for the accuracy of what you log and for maintaining your own device backups. Because we hold no copy of your data, we cannot recover it if you delete the App or lose your device.
4. TummyTrail Premium (subscriptions)
Some features require a paid subscription (“Premium”).
- Billing. Subscriptions are billed through your Apple or Google account at the price shown in the App before purchase. Payment is charged on confirmation of purchase.
- Auto-renewal. Subscriptions renew automatically at the end of each period unless canceled at least 24 hours before the current period ends.
- Managing and canceling. Manage or cancel anytime in your device’s subscription settings: App Store → Apple ID → Subscriptions (iOS) or Google Play → Payments & subscriptions (Android). Deleting the App does not cancel a subscription.
- Free trials (if offered) convert to a paid subscription unless canceled before the trial ends. Any unused trial period is forfeited when you purchase a subscription.
- Refunds are handled by Apple or Google under their policies; we cannot issue refunds directly for store purchases.
- Price changes. If a subscription price changes, you will be notified through the store’s standard mechanism and can cancel before the new price applies.
5. Acceptable use
You agree not to use the App unlawfully, attempt to circumvent Premium restrictions, interfere with the App’s operation, or misrepresent the App’s outputs as medical determinations.
6. Intellectual property
The App, including its design, code, branding, and content (excluding the data you enter), is owned by Dasfair LLC and protected by intellectual-property laws. “TummyTrail” and its logo are marks of Dasfair LLC.
7. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASFAIR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
9. Termination
You may stop using the App at any time. We may suspend or terminate the license if you materially breach these Terms. Sections 6-8 and 10-11 survive termination.
10. Governing law
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law rules. Nothing in this section deprives you of mandatory consumer protections of your country of residence.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated effective date and noted in the App’s release notes. Continued use after changes take effect constitutes acceptance.
12. App store terms
Your use of the App is also subject to Apple’s Licensed Application End User License Agreement (for iOS) and Google Play’s Terms of Service (for Android). Apple and Google are third-party beneficiaries of these Terms with the right to enforce them, and are not responsible for the App, its content, or support.
